About 300,000 budget schools are existing in india, or an estimated 19% of all schools in India, threatening the existence of these schools is a big question, which position themselves between government schools and good private schools in cost and quality of education, is the Right to Education (RTE) Act.

The RTE Act says all schools should be 'recognized' before they start operations. All Schools at whaever level should get government approval by meeting minimum norm on infrastructure and teaching staff. There was no such stipulation until RTE became a law On April 1, pre inception of this law the school had to be only recoznized after class VIII. Along the way, they could get recognized, by meeting the stipulated criteria. The RTE Act has tightened the minimum criteria.The RTE has asked all existing schools, recognised and unrecognised, to meet these new criteria by April 2013 or face closure,fate of many schools lies in dilemma of existence ever since enforcement of the new RTE law.

Since education is a state subject, the RTE Act, which aims to provide free and compulsory education to children of 6-14 years, only lays down model rules. State governments provide the specifics. So, for example, one of the conditions in the RTE is that a school must have a playground. States set the size of the playground. The Delhi government, for instance, requires its schools to have a playground of 900 sq yards.Whatever can be the norm for size, most budget schools will definately struggle. These school are mostly in urban areas operating in residential houses and they don't have a playground. Is their free open land available in urban area of india,if at all land is available, where will they get the money from?

Teacher salary is the other pain point for budget schools. The RTE Act sets the minimum qualification for a primary-school teacher at higher-secondary education with a two-year diploma in education. On an average, only one-third of teachers in budget schools meet this criteria.
